A fun and enjoyable day can easily turn into a nightmare if you are pulled over on suspicion of a DUI.

Just because you are pulled over, however, does not mean that you are guilty. The majority of reasons that a police officer may pull someone over on suspicion of a DUI–speeding, weaving between lanes, or other examples of “erratic driving”–are typically committed by those that are sober. It’s possible that you had one drink too many or were in an unfamiliar area, making your driving seem erratic.

In addition, breathalyzer machines are not infallible–they need maintenance and they need to be properly administered. And you may have failed a field sobriety test, not because you were impaired due to alcohol consumption, but because you were nervous, distracted, or due to a host of other factors. If the police do not follow proper procedure, you could be falsely accused of driving under the influence.

If convicted of DUI charges, you may face three days of jail, mandatory attendance of an alcohol intervention program, six month license suspension, and a $1,000 fine.

If you have been charged with a DUI, it is very possible that you are innocent. At Calhoun, Kademenos & Childress, we can help minimize the damage that a DUI conviction could cause. Our experienced DUI attorneys will work with you to get you the best outcome possible, helping you keep your license, reduce the charges, or even obtain a dismissal of your charges or an acquittal.
